Please read these Terms of Service (“Terms”) carefully before using MyCaseWatch. By creating an account or using the service, you agree to be bound by these Terms.
1. Description of Service
MyCaseWatch is an independent case-tracking service that retrieves publicly available USCIS case status information on your behalf and presents it in plain English. We also provide processing time benchmarks, email alert notifications, and case history storage.
Important: MyCaseWatch is not affiliated with, endorsed by, or in any way officially connected to the United States Citizenship and Immigration Services (USCIS), the U.S. Department of Homeland Security (DHS), or any other government agency. All case data is retrieved from the USCIS public API and is provided for informational tracking purposes only.
2. Not Legal Advice
Nothing on MyCaseWatch constitutes legal advice. The plain-English explanations, status interpretations, next-step suggestions, processing time estimates, and inquiry readiness indicators are general informational content only — they are not legal opinions and do not create an attorney-client relationship.
For legal advice specific to your immigration situation, consult a licensed immigration attorney or accredited representative.
3. Account Registration
You must provide a valid email address and create a password to use MyCaseWatch. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must be at least 13 years old to create an account. By registering, you represent that you meet this requirement.
We reserve the right to terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used in an abusive or fraudulent manner.
4. Subscription and Billing
MyCaseWatch offers a paid Pro Plan subscription processed through Stripe. By subscribing you authorize us to charge your payment method on the recurring basis you selected (monthly or annual).
Cancellation: You may cancel your subscription at any time through the billing portal in Settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
Refunds: Monthly subscriptions may be refunded within 7 days of initial purchase if you have not made substantial use of the service. Annual subscriptions may be refunded within 7 days of the initial charge only. After 7 days, all charges are final and non-refundable. We do not prorate cancellations.
We reserve the right to modify pricing with 30 days' notice to affected subscribers.
5. Acceptable Use
You agree not to:
- Use the service to look up case statuses you are not authorised to access
- Attempt to circumvent rate limits, authentication, or access controls
- Use automated tools to scrape or bulk-query the service
- Resell, redistribute, or commercialise data obtained through the service
- Attempt to reverse-engineer, decompile, or access our source code without authorisation
- Transmit malware, spam, or other harmful content through the service
Violation of these terms may result in immediate account suspension without refund.
6. Data Accuracy
Case status information is retrieved in real-time from the USCIS API. We do not modify or filter USCIS data. However, we cannot guarantee the accuracy, completeness, or timeliness of USCIS case data, as it depends entirely on USCIS systems that are outside our control.
Processing time benchmarks are sourced from publicly published USCIS processing time data and updated periodically. They represent historical averages and do not predict your individual case processing time.
Always verify critical information directly at egov.uscis.gov before making immigration decisions.
7. Service Availability
We aim to provide reliable service but do not guarantee uptime, availability, or uninterrupted access. The service may be unavailable due to maintenance, USCIS API outages, infrastructure issues, or events outside our control.
USCIS API access depends on our continued access to the USCIS Developer API program. If USCIS modifies or revokes API access, we may be unable to continue providing case-lookup features. In such an event, we will notify users and provide a pro-rated refund for any unused prepaid subscription period.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. USE OF THE SERVICE IS AT YOUR OWN RISK.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYCASEWATCH AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR HARM ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be resolved in the courts of Delaware, and you consent to personal jurisdiction there.
11. Changes to These Terms
We may update these Terms from time to time. We will update the “Last updated” date and notify registered users by email at least 14 days before material changes take effect. Your continued use of the service after changes take effect constitutes acceptance.
